If you are a board member or property manager of a homeowners’ or condominium association, you can face several unique challenges. You may be inundated with emails and complaints from fellow unit owners or have trouble collecting dues from certain members of the association. Often, neighbouring property owners come to you to settle disputes between them regarding rules violations or property damage.
In Louisiana, especially in more highly populated areas, such as Orleans, Jefferson, and St. Tammany Parishes, condominium and homeowners’ associations are everywhere. Their goal is to maintain a cohesive group of owners, who agree to pay dues and follow common rules that preserve property values and are nuisance-free.
It is critical that each association member follow the promulgated rules and contribute their dues, or else these rules and the association become practically ineffective. On the front end, associations need appropriate governing documents and rules that provide fair yet effective deterrents to rule-breaking. And if rules are broken, the association should act quickly to force the violating member to comply.
